It appears that the problem isn't Xbox Live necessarily but Microsoft's whole cloud service. It's much bigger than gaming.

i was able to download the dlc, but when i get into the game, it's not an option and the server browser choices tell me i have to purchase the dlc. This is lovely.

You have to go into store and download it from there after the patch

I think they messed with the l85 as well... I noticed a higher first shot recoil. But I didn't see anything in the patch notes.
