Thanks Lamda and for sure well be gaming together in the foreseeable future.
Update on the situation is as follows - phoned Microsoft earlier this morning as it boils Dow to the fact that the initial day 1 update didn't download correctly which is what I expected to hear back.
I had 2 options,1 to seen it to Microsoft that would take a long ass fucking time and out me money out of pocket for shipping fees or return it under the 30 day sales period to the original retailer and let them deal with it.
I opted for the 2nd as the said they will replace it and dispatch a brand new console within 3 working days of recieving the troublesome one.
So for now ill be offline until I receive the new console expected Tues or wed.

So the xbox 1 got taken back to Carphone warehouse.
I never took it in store as I would have hit the sales rep with it so I had the wife take it in.only question I needed he to make sure of was once the new one is dispatched does the 28 day return period start fresh as in my opinion it should and the customs is always damn well right.
So I waited in the car for around half an hr and thought what's taking so long then the Mrs comes back and tells me the news.
Apparently the sales rep that dealt with us said that the was an xbox1 in another sister store that hadn't been allocated and turns out he lived close by that particular store.
He said that he would pick it up tonight and bring it down to his store tomorrow so that I can collect it.so all being well I should have the new one in my possession just after 11:30am.
My boys started back to school to day so tomorrow I should be able to get home after the pick up and have a bit of time to set the thing up which hopefully goes a tad better than last nights nightmare but I'm not gonna hold my breath until I see that xbox 1 dashboard on my tv
